10DLC Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of our 10-Digit Long Code (10DLC) messaging services (“Services”). By accessing or using the Services, you agree to comply with and be bound by these Terms. If you do not agree, do not use the Services.
- Definitions
- 10DLC: A sanctioned system that allows businesses to send Application-to-Person (A2P) text messages via a standard 10-digit phone number.
- User: Any individual or entity that uses our Services to send or receive messages.
- Content: Any text, media, or other data transmitted through the Services.
- Compliance with Laws and Regulations
Users agree to comply with all applicable federal, state, and local laws, including but not limited to:
- The Telephone Consumer Protection Act (TCPA)
- The CAN-SPAM Act
- Guidelines from the Mobile Marketing Association (MMA)
- Carrier-specific requirements
Users must also adhere to all guidelines set forth by The Campaign Registry (TCR) for 10DLC registration and messaging.
- Registration Requirements
To use 10DLC messaging, you must:
- Complete the required registration with TCR, including submitting accurate business and campaign information.
- Use only approved campaigns and messaging content as defined during registration.
- Maintain up-to-date registration records.
Failure to register or provide accurate information may result in suspension of Services.
- Prohibited Activities
Users are strictly prohibited from:
- Sending unsolicited messages (SPAM).
- Transmitting illegal, harmful, or offensive content.
- Violating copyright, trademark, or other intellectual property rights.
- Engaging in fraudulent, deceptive, or misleading practices.
- Sending messages that violate carrier or TCR guidelines, such as:
- Hate speech
- Gambling promotions
- Unauthorized financial services
- Consent and Opt-Out Requirements
- User Responsibility for Consent: Users must obtain proper opt-in consent from message recipients prior to sending any messages.
- Opt-Out Mechanism: All messages must include clear instructions for recipients to opt out of receiving further messages (e.g., “Reply STOP to unsubscribe”).
- Honor Opt-Out Requests: Users must immediately cease sending messages to recipients who opt out.
- Fees and Charges
- Users are responsible for all fees associated with 10DLC registration, messaging, and carrier surcharges.
- Fees may vary based on carrier regulations and message volume.
- Message Delivery
- While we strive for reliable message delivery, we cannot guarantee delivery due to factors outside our control, including carrier outages or recipient settings.
- Messages flagged for non-compliance may be blocked by carriers without notice.
- Suspension and Termination
We reserve the right to suspend or terminate your access to the Services if you:
- Violate these Terms or any applicable laws.
- Engage in prohibited activities.
- Fail to maintain accurate registration records.
- Limitation of Liability
We are not responsible for:
- Loss of revenue, profits, or data resulting from the use of our Services.
- Fines, penalties, or damages arising from non-compliance with applicable laws or regulations.
- Indemnification
You agree to indemnify, defend, and hold us harmless from any claims, damages, or expenses arising from:
- Your use of the Services.
- Your violation of these Terms or any applicable laws.
- Amendments
We may update these Terms at any time. Users will be notified of significant changes, and continued use of the Services constitutes acceptance of the updated Terms.
- Governing Law
These Terms are governed by the laws of New York State, USA. Any disputes shall be resolved in the courts of Onondaga County, NY.
